Driving a drunk friend home when you and him are minors illegal?

Well I was wondering, say, if me and my friend go to a party, and he gets drunk and I’m sober. If I give him a ride to his house and get pulled over going there, can I get in trouble if he is drunk? Keep in mind that we are both minors.

No, only he will be in trouble. You will be doing the right thing.

  4. susansgiftshop Says:

You may be sober but minors who are drinking can get arrested and in trouble.

  5. eastonkirsten Says:

It depends on the cop. Legally you shouldn’t be driving a minor, but its better that you are driving him home, than him driving home drunk. Most cops would let you off for good behavior.

  6. Kenz Says:

nope. it is incoruged to be responisble and not drink and drive. nomatter what, the officer wont question your friend, you would be the only one being questioned because your the driver.

  7. birdman Says:

as long as you have a drivers license, you are ok, but your friend is in deep s%&*

  8. lois d Says:

yes but might not be as bad if he was driving.

  9. Derby Girl Says:

Your friend will get in trouble for underage drinking, you will get in trouble for whatever you get pulled over for, DUH!

  10. Dee Says:

Well no crap if you and him are minors, drinking is illegal.. But no you don’t get in trouble..

  11. Shawn F Says:

not if you posses a valid drivers licens, but he will get in trouble for drinking as a minor

  12. cityofmobile Says:

you need a driver’s license or a permit to drive legally but i wouldn’t worry about it if you are driving a drunk

  13. lacrosselover Says:

You will get in trouble if you don’t have a driver’s license or if you have a permit and it’s past curfew.

  14. ♥New.Me♥Love.Carly♥ Says:

being drunk in the first place is illegal. dhurrr.

  16. Streaker Says:

yes, public intoxication is the charge but I suggest that he sleep it off somewhere without having to drive home. If you have to drive, follow the law of the road and be careful.

  17. barbielady Says:

I got stopped driving at 17 with no license with 2 drunk men in the car. I explained the situation to the cop and he was just like whatever I never saw you, k?

I have no idea what would’ve happened to me if he wouldn’t have taken pity on me…

  18. joe c Says:

as long as your sober i don’t think so ,and you get extra credit for doing the right thing.

  19. Robert D Says:

    I’m going to doubt it.

You can not be held responsible for your friend, since you are also a minor.

If you are driving legally, then you have done nothing wrong.

In fact, Brava! (For driving for your friend)

  20. subwayxyujykape Says:

Yes, even if both of you are minors. Drinking alcohol is for 21 and up and not for minors.

  21. Beyounce Says:

    yes!

    minors can’t drink

  22. daniriz♥ Says:

yeah, u dont need that kind of trouble. pls….

  23. v63 Says:

not only will both of you be in trouble , but your parents are also liable. don’t drive!

  24. anon123 Says:

Wait, so your friend is drinking underage, you’re driving underage, or your friend is possibly drinking and driving, underage on BOTH accounts, and you want to know if anything illegal is going on here.

    No, of course not.

  25. Ginny T Says:

Unless you were supplying him with the alchohol there is no law against you being in the presence of an alchohol impaired person.

  26. dietzcasey Says:

You can not get into touble, but the police may detain him on site for under age drinking. The only way that they can detain you is if you had anything to drink.

  27. Peepin it real Says:

I dont think so…. not unless you gave him the alchol..I used to drive my drunkard friends home..i had an older bf though who would get drunk as hell and piss himself…wow was such a douche….ok anyways..where was i?…..I think that’s a very responsible thing for you to do..congrats to dat…. I think the law would look more favorably on you if your preventing a drunk driver from endangering other….but then again..i’m not sure i understand…are you both old enough to drive? if you only have a permit..or you dont even have a permit you may be in a little bit of a jam…but they’ll probably take you intentions into consideration…

  28. udaya17lanka Says:

Yup! U guys r kids nt adults yet! Rules r rules!

  29. bad speller Says:

if you get cot you will go in jail

  30. angela d Says:

they may go a little easier on you but in the long run yes it’s just as illegal

  31. sugar bear Says:

If you haven’t been drinking & have a valid drivers license, then you should have no problem getting your friend home! If your really worried about it, call your parents. They will be glad to make sure that the children they love are getting home safely!!! Even if they harp a little bit!

  32. wat u talkin bout? Says:

Minors, as in, you don’t have a drivers license? You’ll both get in trouble. If you have an unrestricted license then you won’t get in trouble but he will.

  33. Judi P Says:

You should be safe as long as you have a valid license and there are no open (even if empty) containers in the car.

  34. meaganspice Says:

i dont think that you could not get in trouble for that as long as you have your drivers i.d. then you should be good. but if he is a minor, he could get it for underage consumption! so be careful and try not to get pulled over. thats the best think i can tell you! if you do, have him chew gum and then spit it out before the cop gets to the car. it could help.

  35. Cecilia V Says:

yes. You can get in a lot of trouble for that. Now if u are planning on doing this i seriously DO NOT RECOMMEND that u do it.If u did it in the past I really hope u take my advice on never doing it again. How old r u anyways??

Also he will get into more trouble because he is a minor that has been drinking so thats basically a double whamy for the police if u got cought. and u better have a drivers liscence or its a triple whamy if u got cought.

    good luck with that!

  36. crosstwntraffic Says:

You wont get in trouble because your buddy is drunk, alot of cops respect a kid that give a friend a ride if he’s too drunk to drive. You will however get in trouble for whatever they pulled you over for in the first place. And if your out after curfew.

  37. mark Says:

You need to have a license and obay the restrictions on your license if your state has a graduated license system . Its best to put him in the back seat on the passenger side with a seat belt , so you can see him in the rear mirror .

Its probably best that you call a parent for a ride home . You dont want to risk an accident because he does something unexpected .

  38. sha Says:

I think that you would want to play it cool, make sure that you have your license and insurance stuff handy, and NO OPEN CONTAINERS or weed, etc. in the car, trunk, or on you, or your friend. To play it safe, maybe call your folks and let them know what your up to. Cops have a way of hassling minors that could be trouble, especially if you show ANY disrespect. My Motto is if it doesn’t feel right don’t do it.

  39. Rick K Says:

You should be fine, as long as you haven’t had a drink, and you have a valid drivers license. But make sure there are no open containers in the car, or you could be in big trouble!

    Happy New Year!

  40. poopsie Says:

well its too bad that you have to drink, but if you get pulled over, you could loose your d.l., depends on which state you live in,all though, if you are driving a drunk friend home, it would be good, depend’s on the state!!!

  41. ifixit54 Says:

    You will be fine……………………..
    He will be Toast…………………….

  42. taraya161 Says:

Who ever supplied the booze is liable in every state I know of. Do a reality check on yourself to see why you’re hanging around with a drunk person. P.S. If you got/get pulled over you must’ve done something wrong.

  43. steven c Says:

It is illegal for him or her to be drunk not illegal for you to drive them home if you are sober.
